Hurley Family Tree

This Deed, made and entered into this 5th day of October, eighteen hundred and forty-nine, by and between John Hutchings, Senr., and Mary [or Polly,] his wife, of the first part, and John Hutchings, Junr., of the second part, Witnesseth: That the said parties of the first part, for and in consideration of the sum of one thousand dollars to them in hand paid by the said party of the second part, receipt whereof is hereby confessed and acknowledged, have bargained, sold, and conveyed, and by these presents do bargain, sell, convey, and confirm unto the said party of the second part, his heirs and assigns forever, all of their right, title, interest, and claim in and to the following described real estate, situate on Big River, Bellevue Township, Washington County, State of Missouri, to wit:

The west one-half (½), divided by a line hereinafter mentioned, of all that portion of the tract of land not heretofore disposed of and lying north of Big River and east of Clear (or Silver) Creek, extending to the middle and along the waters, both supposed in all to be four hundred acres. Two hundred acres, more or less, of which is hereby conveyed to the said John Hutchings, Junr., lying on the west side of a line commencing on the bank of Big River near two hickory trees and one elm, and running North forty (40) degrees West, magnetic, fifty-two (52) poles, where it strikes the spring branch; thence up the middle of said branch to a point twenty-seven (27) links southwest of a red elm, near which stands a white oak about one foot in diameter and a chinquapin oak about fifteen inches in diameter, the three trees forming a triangle; thence South sixty-seven (67) degrees West, magnetic, sixty-nine (69) poles to a sugar tree about ten inches in diameter; thence North thirty-five (35) degrees West, magnetic, to the old line, being the same on which the said John is now about building a house, in Township thirty-six (36) North of Range two (2) East.

For a more particular description of which, reference can be had to the patent made by the United States of America to Elisha Baker's representatives, being designated on the connected plat as number two thousand one hundred and fifty (2150), recorded in Volume 7, pages 88, 89, 90, and 91, in the General Land Office at Washington City, dated 26th March, 1829.

To have and to hold the same, with all the rights, privileges, and appurtenances thereunto belonging or in any wise appertaining, unto John Hutchings, Junr., the said party of the second part, his heirs and assigns forever. The said John Hutchings, Senr., and Mary [or Polly,] his wife, parties of the first part, hereby covenanting that their heirs [and] executors will warrant and forever defend the title to the said premises, and every part thereof, to the said John Hutchings, Junr., party of the second part, against the lawful claim or claims of all and every person or persons whatsoever claiming or to claim the same or any part thereof.

In testimony whereof, the said parties of the first part have hereunto set their hands and seals the day and year first herein written. The words interlined, "chinquapin oak about fifteen inches in diameter," were put in before signing.
